摘要:民间借贷是个复杂而极具争议性的问题,大家都知道它的弊,却又不能否认其存在的价值。近年来,金融界、经济界和法学界的学者们对民间借贷的引导、发展和治理等问题上进行了大量的研究,在引导民间借贷走向“规范化”道路上,各界基本上达成了原则性共识。然而,应该怎样走“正规化”的道路,依然成为备受关注的问题。 本文系运用规范研究方法进行的专题研究。首先对民间借贷概念进行阐释,然后比较民间借贷和其他金融机构借贷的不同,接着就是阐述民间借贷的发展现状和在发展过程中所存在的问题,以及造成障碍存在的原因,包括金融体制不完善和民间游资过多等因素。最后对民间借贷发展做了展望与评价,提出了一些规范民间借贷的对策和建议:要制定完善合理的民间借贷法规和办法,银监会应切实担负起金融监管职责,制止和规范民间借贷行为等建议,政府应切实改善投资环境,鼓励引导民间资金直接资。 关键词:民间借贷,规范化,金融体制
Abstract:Informal finance is a very complex and disputable problem. Although it has many drawbacks we can not deny its value and its existence. In recent years, financial, economic and legal scholars on the academic guidance of private lending, development and governance issues were a lot of research, private lending in the guide to "normalize” the road, all basically reached in principle Consensus. However, how should they go, "normalization” of the road, a major concern? This article is normative research method using the project research. Firstly illustrates folk lending concept, especially the development folk lending situation, then compare the private lending and other financial institutions lending is different, then elaborated folk leasehold development process of the existence of the problem, as well as create obstacles exist, including the financial system is not perfect and the civil capital to wait too much factors. And puts forward some normative folk lending countermeasures and Suggestions: to make perfect reasonable folk lending regulations and measures, the CBRC shall earnestly shouldering financial regulatory responsibilities. 本文通过一些实际的例子对民间借贷进行分析,从发现问题,提出问题在到最后寻找解决问题的措施。在我国,为了促进中小企业的发展,有效地解决中小企业的融资难,不断提高其竞争力。应改借鉴做得比较好的地区的做法,例如浙江温州对中小企业政策扶持的经验,抓紧出台一些具体的财税政策和货币信贷政策,明确其优惠税率,对劳动密集型的中小企业给予适当的政府补贴和金融支持,为此,必须做好以下工作:首先,要严格执行十届人大二次会议通过的宪法修正案中关于保护私有财产的法律制度,制定“社会信用管理基本法”、“中小企业金融法”和“风险投资法”,出台“民营企业发展与保护条例”,完善《中小企业促进法》的配套法规。其次,要建立健全严格保护、支持中小企业合法权益的长效机制,严惩各种形式的直接或间接损害中小企业合法权益的行为。再次,要彻底改变长期以来我国对中小企业及投资者的司法救济缺位现象,努力为中小企业的财产权、融资权以及其他合法权益提供有力的司法保护。最后,中小企业也要增强自身法制观念,努力确保国家各项法律制度得到严格实施,为解决中小企业融资难、促进民间借贷的健康、有序发展,形成法律保障机制。
