内容摘要:劳动派遣制度中形成了劳务派遣单位、被派遣劳动者、用工单位之间的三方关系,需要有效地分配雇主义务与责任以维护各方权益的平衡与劳动者利益的保护。双重特殊劳动关系说认为在派遣单位与派遣员工之间和用工单位与派遣员工之间都存在劳动关系,即派遣单位与用工单位都是派遣劳动者的共同雇主。在此基础上,结合我国《劳动合同法》的相关规定,在外部关系上,劳务派遣单位与用工单位应共同对外承担连带责任;内部关系上,两个雇主之间签订的劳务派遣协议中的约定优先,有约定的从约定,没有约定或约定不明的,应当由被派遣职员的实际“控制”者来对受害人的损失承担责任。 【关键词】劳务派遣 派遣单位 被派遣劳动者 用工单位
