摘要:新刑法已明确规定“逃逸”行为为交通肇事罪的量刑情节,并将“因逃逸致人死亡”情节加入其中,与旧刑法相比的确有所提高。2000年11月10日最高人民法院颁布了《关于审理交通肇事刑事案件具体应用法律若干问题的解释》,《解释》中将“逃逸”规定为犯罪构成要件,使得法律对交通肇事后逃逸行为的规定得更加深入,但是现行法律对交通肇事后逃逸行为的定性问题规定的不够细致。首先,我国法律及司法解释对“交通肇事逃逸行为”的界定不明确,存在许多争议。其次,“交通肇事逃逸行为”是交通肇事罪的法定从重情节不利于定罪量刑。本文认为立法及司法机关应将交通肇事逃逸行为进行准确定性,并要将交通肇事逃逸行为独立定罪来解决现行法律中存在的问题。 关键词:交通肇事;逃逸行为;定性;独立定罪
Abstract:“Escape” behavior has legislated as one of the crime of causing traffic casualties’ sentencing plots by the new Criminal Law, joining the “escape death”, which are improving compared with the old one.Interpretations of concrete application in trying criminal cases of causing traffic casualties, issued by the Supreme People's Court On November 10th 2000, has defined “escaping” as a crime constitutions, which are deeper definition of “escape” behavior after causing traffic casualties. But the current law about qualitative problems of that is lack of carefulness.Firstly, it’s not clear of definition of “escape” behavior after causing traffic casualties in our laws and judicial interpretation, which still exists disputes. Secondly, it is the crime of causing traffic casualties’ legal severely plot, against the convicting and sentencing.This essay holds the opinion that legislature and judicial authority should accurately determine the nature of “escape” behavior after causing traffic casualties, and independently convict it to solve the problems of current law.
