摘要:现代引渡制度作为国际刑事司法合作的基本形式之一，对惩处与防范国际犯罪起着不容忽视的作用。随着人权原则在国际社会的不断深入，人权保护原则亦介入引渡制度中并对其产生了巨大的影响，如“死刑不引渡”、“政治犯不引渡”“双重犯罪”等原则的确立与适用。在当今国际社会高度发展的前提下，我国的引渡制度如何在充分保护人权的基础上顺应时代潮流跟上国际的步伐，从而不断的发展和完善我国的引渡制度，是值得我们共同关注的问题。本文通过分析人权保护对引渡制度的影响以及人权原则下引渡制度存在的问题，进一步指出了现代引渡制度应以保护被请求引渡者的人权为前提而得以存在和发展，从而对我国的引渡制度提出若干完善的立法建议。

Abstract:Modern extradition system of international criminal judicial cooperation as one of the basic forms of punishment and prevention of crime, international plays a role that can’t be ignored. With the principle of human rights in the international society is ceaseless and thorough, the principle of human rights protection is also involved in the extradition system and its produced tremendous effect, such as" non-extradition of death penalty"," non-extradition of political offenders ","double crime" principles. In current international society height under the premise of development, China's extradition system how to fully protect human rights on the basis of conforming to the trend of the times to keep up with international pace, so as to continuously develop and improve our system of extradition, is worthy of our concern. In this paper, through the analysis of the protection of human rights on the extradition system and the influence of the human rights principles of extradition system problems, and further pointed out that the modern extradition system should be to protect the requested extradition human rights the premise of existence and development, so as to China's extradition system puts forward some legislative suggestion.
