摘要：公共秩序保留制度是国际私法中的一项重要制度，但近年来国际上有限制公共秩序保留制度适用的发展趋势。公共秩序在排除外国法适用，保护本国利益方面起到了至关重要的作用，我国应该不断完善公共秩序保留制度的立法，维护国家的公共利益，促进国际民商事关系的良性发展。

　　　文章共分成四部分进行论述。第一部分从涵义、作用及意义三个方面对公共秩序保留制度进行了简要的介绍。第二部分阐述了各国公共秩序保留制度的立法和发展趋势。第三部分介绍了公共秩序保留制度在我国的立法和司法实践。第四部分针对我国有关公共秩序保留制度存在的问题，从立法及司法实践两方面提出完善措施，以逐步实现公共秩序保留制度在我国国际私法领域的不断进步和完善。

Abstract:Reservation of public order in the international justice system is all important system，but in recent years， there are still restrictions on the reservations regime trends．Protection of local interests has played a vital role China should continue to improve the reservation system of public order legislation to safeguard the public interest and to promote international civil and commercial relations between the benign development．

　　　The paper consists of four parts， The first part，the content of which is mainly about the basic definition，has made a brief introduction of the reservation of public order from the essence、function and as for the term of the public order．brief．The second part describes the legislation and developing trends of he reservation of public order in some countries．The third part demonstrates the legislation and practices of the reservation of public order in China. The fourth part is put forward the suggestions in the legislation and practices，To realize the gradual improvements and perfection of the system in China．
