摘要:就业是人民改善生活的基本前提和基本途径。妇女的就业更是妇女获得经济独立和人格独立的重要保障。随着我国经济体制的急剧转轨和社会结构的转型,妇女所面临的就业环境和实际就业状况正在发生深刻的变化,许多妇女成了就业中的弱势困难群体。通过制度创新完善对妇女平等就业的法律保护,是一个关系到社会稳定,关系到建立和发展市场经济体制,以及全面建设小康社会的重大问题。本文正是针对妇女就业过程中法律保护的不足之处展开论述,对妇女平等就业权的法律保护进行进一步完善。 关键词:平等就业;妇女;性别歧视
Abstract:Obtaining employment is the basic premise and way for the people to improve their life. It is also an important guarantee for their economic independence and independent personality, especially for the women. With the rapid development of China’s economic system and social structure, women are facing a great change in the working environment and the real world working situation, and many of them become the vulnerable in the working groups. It is an important job to improve the protection of women’s equal right to work through institutional innovations and system amend, as it has a great influence on the social stability, the establishment and development of market economy system and building a moderately prosperous society. This article is to discuss the inadequacies of the legal protection of women’s employment process, and to improve the legal protection of women’s equal right to work. 随着我国人权事业的发展,我国女性就业平等权的法律制度在发展,但是法律的规定仍然不足。对性别歧视的含义在理论界无统一的说法,国际劳工组织《(就业与职业)歧视公约》对“妇女歧视”一词做了比较明确的解释。构成违法的性别歧视需要法律的明文规定,但我国目前从未从法律的角度界定“歧视”的内涵,因此以“歧视”为理由提起的诉讼常常难以得到法院的支持。实践证明,女性就业问题随着市场经济的不断深入而变得更加明显。为什么在相关立法完善的情况下,与立法初衷相违背的现象还会层出不穷?如何对妇女的平等就业权的法律保护进行完善?这应该引起我们的思考。
