摘要:随着我国住房商品化的全面开展,购买商品房已成为广大居民实现自身居住权利的主要途径。但一些商品房开发商利用商品房买卖合同签订及履行中的优势地位,不遵循诚实信用的商业原则,采用各种不法手段追求利益最大化,导致商品房质量不合格,此外欺诈、虚假广告等现象也普遍存在,这些都侵犯了商品房消费者的合法权益。尽管我国先后制定了多部规范商品房交易市场的法律法规,但仍不足以弥补消费者所受的侵害。因此,本文针对商品房交易中消费者权益保护存在的缺陷,提出符合现行法律框架内的建议,以期更好实现商品房消费者权益的保护,促进我国房地产行业的健康发展。 关键词:商品房;消费者权益;法律保护;惩罚性赔偿
Abstract:Along with the full commercialization of housing, purchase house has become the main way to realize their rights of residence of the residents. But some commercial housing developers using mercenary contracts entered into and performed in the advantageous position, does not follow the principle of honesty and credit business, using various malpractices in pursuit of interest, leading to disqualification of commercial housing, in addition is also common, such as fraud, false advertising, they are a violation of the legitimate rights and interests of consumers of commodity property. Although China has made a number of market laws and regulations regulating commercial transactions, but not enough to make up for the consumer has been against. Therefore, this paper focuses on commercial transactions in the defects of consumer rights protection, consistent with existing law within the framework of the recommendations made with a view to better housing consumer protection, promote the healthy development of China's real estate industry. 随着我国社会主义市场经济的发展和住房制度改革的不断深化,商品房这种特殊商品在人们生活中的地位日益重要。但现实中,消费者在购买商品房时,其合法权益往往容易受到侵犯,主要表现在商品房质量不合格、开发商虚假广告、隐瞒重大事实等。另外,由于商品房消费者权益保护的立法滞后,使得大部分消费者得不到应有的救济,致使消费者的合法权益得不到充分的保护。这一状况不仅侵害了消费者的生存权益,也不利于房地产业的健康发展。因此,加强商品房交易中消费者权益的法律保护是当前亟待解决的问题。 |
