摘要:建筑物区分所有权制度在我国起步较晚,发展不够成熟,难以适应区分所有人间日益复杂的所有权关系调整的需要。本文从完善建筑物区分所有权制度的必要性出发,分析该制度在我国存在的缺陷。其中,对于商铺与民居结合产生的多元矛盾、建筑物新增制度的缺位、建筑物管理制度的模糊这三个问题作深入的研究分析。笔者通过借鉴建筑物区分所有权制度在国外的相关制度和经验,对完善我国建筑物区分所有权制度提出了具体的若干构想。 关键词:建筑物区分所有权制度;住宅商用;建筑物增建;物业管理
Abstract:Condominium ownership system in our country was too late to start and it is not conform to the development and the need of the complicated ownerships. Start with analying the necessity of the existence of condominium ownership system,this dissertation points out the defects of the system in our country.Especially,multiple conflicts caused by the commercial use of dwelling house,the absence of the institution catered for add buildings and the unclear of the property management system are analyzed in depth. Referring to foreign condominium ownership system’s related system and experience, the author puts forward several possible improvements for the condominium ownerships system. 《物权法》是我国第一次对建筑物区分所有权作出规定,无论从理论还是实践中都具有非常重要的价值,但由于实行的时间太短,尚没有经过时间的检验和论证,还存在许多不足之处。从《物权法》这几年实践的情况来看,我国建筑物区分所有权制度的缺陷日益突出,如商住结合的建筑物中纠纷解决制度的缺失,建筑物增建制度的缺失,物业管理制度规定的模糊,导致很难切实保障建筑物区分业主的合法权益。
