内容摘要：民事诉讼第三人制度是我国民事诉讼审判制度的重要组成部分，我国民事诉讼审判程序中的诉讼第三人制度分为了两个部分包括有独立请求的第三人和无独立请求的第三人，但是随着时代的发展原先的分类已经无法较好的适应审理案件的需要，对于原有的比较粗略的第三人划分制度，必定要进行进一步的细化区分，尤其是对于无独立请求权的第三人制度必须要进行进一步的细化，为了完善我国的民事诉讼第三人制度十分有必要对国外和港澳台地区的民事诉讼第三人制度进行相应的学习和借鉴，并且充分听取和采纳我国有关法学专家学者的意见针对民事诉讼第三人制度在实施过程中出现的问题和现实社会发展的需要来塑造一个符合社会主义市场经济和社会主义和谐社会发展需求的民事诉讼第三人制度。
