【摘要】物业区域中公共部位的收益均应归全体业主共同所有,任何单位和个人都不得侵吞。但是,在小区中,普遍存在物业侵占公共部位的违章现象。随着《物权法》对“建筑物区分所有权”的细化,一定程度上对小区共有部分的产权进行了明确,但并非每一种违章现象的出现都要通过法律诉讼才能解决,笔者认为,只有行政机关及时核查,物业公司尽职尽责,业主积极配合,小区的各项管理才会越来越好。 【关键词】物业区域 公共部位收益 物业 业主
