摘要:通过调解解决劳动争议有利于劳动争议的及时、彻底解决,更有利于节约司法资源和构建和谐的劳动关系,但由于劳动争议调解制度在我国现行法律法规中没有得到明确的规定,至于在实践中该制度一直被忽视,从而使到调解在劳动争议处理过程中没有发挥出其特有的特点。因此无论从国家政策、法律法规还是实践的角度来看,完善我国劳动争议调解制度都是势在必行的。本文通过对劳动争议调解的经济价值、效率价值以及立法价值进行分析,进一步指出了完善该制度的必要性,同时通过对国外关于劳动争议调解制度的分析,对完善我国劳动争议调解制度提出了具体的若干建议,以期有利于对该制度的完善。 关键词:劳动争议调解;调解制度;调解协议;调解机构
Abstract:Based on the Labor dispute mediation of the economic, efficiency and legislation value analysis, further points out that the necessity to perfect the system .No matter from state policies, laws and regulations or the practice's point of view, perfect our country's labor dispute mediation system is imperative. Because of the labor dispute mediation system in China's existing laws and regulations did not clearly defined,and the mediation system has been neglected in the judicial practice. So at last, it didn't play its unique advantages. To perfect the labor dispute mediation system, through drawing on the experience exist in other countries on China's perfecting the system of a number of recommendations put forward specific, in order to help to the improvement of the system. 劳动争议调解具有及时、便捷、经济、安全等特点,同时加上劳动纠纷所具有的特殊性,由此决定了调解是劳动争议处理程序中的一个重要方式。所谓劳动争议调解,指的是劳动争议调解组织依照法律法规,通过沟通和协商,促使劳动争议双方当事人互谅互让、自愿达成协议,从而解决纠纷的一种法律制度,是劳动争议处理的第一道防线。随着我国市场经济体制改革的不断深化,劳动关系日渐复杂,劳动争议案件处于大幅度增加的状况下,我国劳动争议调解制度的不完善使得其难以适应现实需要。因此,有必要对我国的劳动争议调解制度进行完善。
