内容摘要:劳动者单方预告解除权是劳动者享有的,通过提前三十天书面预告通知用人单位而无需用人单位同意即可解除劳动合同的权利。劳动者预告解除权制度的确立有利于充分保障劳动者的合法利益,优化社会劳动力资源配置。然而该制度仍然存在着预告期一刀切、不区分劳动合同种类而适用、解除劳动合同后责任认定不清、对强势劳动者规制不足的缺陷,在实际问题操作中带来了很多不便。根据国外劳动立法经验和实务中的实际情形,劳动者预告解除权制度应针对其弊端有所完善,主要表现为细化预告期的设定、根据合同的不同种类来规定对单方预告解除权的限制、立法明确劳动者行使预告解除权所应承担的对应责任,加强对强势劳动者的规制。 关键字:劳动合同 预告解除权 预告期
Abstract: Laborer unilaterally terminate workers enjoy forecast is 30 days in advance, through the written notice to the employing unit trailer without employer agreed to remove labor contract rights. Laborer forecast the establishment of the system of termination right to fully guarantee the lawful rights and interests of laborers, optimize social labor resource allocation. Yet the system still exist forecast period fits, don't distinguish between labor contract type and applicable, remove after labor contract responsibility identification is not clear, strong laborer regulation for the weakness of the practical problems in operation, has brought much inconvenience. According to foreign labor legislation experience and practice of the actual circumstances, laborer forecast rescission system should be aimed at its drawbacks has perfect, main show is thinning forecast period according to the contract of the setting, the different kinds of home remedy forecast to provisions of the restrictions, the termination right legislation explicitly laborer should exercise forecast rescission of corresponding responsibility, to strengthen the regulation of strong laborer. 【key words】Labor contract forecast rescission forecast period |
